BAD THINGS CAN HAPPEN TO GOOD WORKERS
We know a work injury can happen to the most careful and dedicated worker. It's not fair for a worker to have their life destroyed by an injury that happened while working for someone else. But not all work injuries are obvious, pain may happen days following an accident or build up over time due to repetitive work. Therefore, it is important to know that you have a right to benefits even if there is no "at-fault" party. When injuries build up over time, we call that cumulative trauma. A worker deserves treatment just as much for cumulative injuries as a worker that fell from a ladder and was rushed from work to the emergency room. Unfortunately, workers with repetitive injuries are usually told by their employer that they should go to their own doctor. If the employer does allow a worker with repetitive and cumulative injuries to go to a doctor, the insurance company is not going to provide workers compensation benefits for such a claim. This is done simply by sending a denial letter.
When there is no blunt trauma, or specific moment of injury, insurance companies usually deny a claim. We know the laws that will overcome the denial of repetitive work injuries. However, a denial of a claim is not the only way to prevent an injured workers from getting benefits, the insurance may say that it happened on a specific occasion because this is easier for them to control. When the insurance says an injury happened on a specific date rather than building up over time your medical history is not appropriately documented. This negatively affects the claim. It is important to ensure everything is set up correctly so you do not have to dig out of an administrative hole in the future.
CALCULATING YOUR AWARD IS IMPORTANT
We know how to use the AMA Guides to rate your injuries. Money is awarded to an injured worker by calculating the level of damage done by an injury. We are highly experienced and trained to use the medical charts to maximize settlements. Settlements are paid by the workers' comp insurance company, not your employer, and they will manipulate the doctors and the process to lower the money injured workers get.
Money is available to an injured workers because of an inability, or reduced ability, to compete in the labor force. The system of providing bodily impairment is controlled by the insurance company and it is crucial that you have the experience and knowledge regarding the process of acquiring the appropriate reports (which is evidence) and then to be able to bring the reports and argue before the judge. The impairment must first be rated according to the appropriate rating schedule, which is different for each worker depending on their age, job and injury. If you don't have an attorney to build your case, or you are signing an agreement without a skilled workers' compensation certified specialist you are at an extreme disadvantage.
INSURERS WILL TRY TO DENY OR REDUCE WORK COMP BENEFITS
We know claiming your workers comp benefits is never easy. Employers may ignore your request for treatment. If they do send you for treatment and hand it over to the insurance company an experienced "claims adjuster" is assigned to your case. That adjuster's job is to limit the amount of money the insurance company has to spend on you. They will usually send you to a doctor they have a strong relationship with, a doctor who receives a steady stream of work coming from the insurance company, and therefore has every incentive to keep the insurance company happy at the expense of your health and finances. You do not have to simply see "their" doctor. Insurance companies will want to send you to US Healthworks, Concentra, or any other large industrial clinic.
HOW MUCH DOES A LAWYER COST
Many people don't get a lawyer because they think a lawyer is too expensive. Unlike civil attorneys that take up to 40% of an award, we are paid 15% of settlement, paid by the insurance company, and only if we win. Given the complexities of workers' compensation laws, we have always been able to increase the award by more than the 15% we take for representing an injured worker. So it is worth getting an attorney because the money earned in a workmans comp claim goes up substantially with our representation.
